Legal position last reviewed: July 2026
We work daily with Brussels IV (EU Regulation 650/2012), so a foreign national's estate can be governed by the law of their nationality, not Spanish forced heirship.
Where it applies, we claim the Comunidad Valenciana inheritance bonus for close family, which can include non-residents, to keep the tax as low as the law allows.
We prepare the deed of acceptance, file the inheritance tax and register the Dénia property in the heirs' names, so families abroad are guided through every step.
Your Spanish will and the probate are drafted and signed under Juan Bertomeu, abogado colegiado ejerciente, ICALI #4643.
We help foreign families with property in Dénia and the Marina Alta: a British couple with a villa on the Montgó, a German widow with an apartment in Las Marinas, a Dutch or Belgian family with a home in La Xara or Pedreguer. Spanish forced-heirship rules and the six-month inheritance tax deadline make early planning essential, and a Spanish will with the right choice-of-law clause is the single most useful step most foreign owners can take.
We draft a Spanish will over your Spanish assets with a Brussels IV choice-of-law clause, so your estate passes the way you intend.
Through professio juris we let most foreign nationals elect the law of their nationality over Spanish forced heirship (legítima).
We prepare the deeds of acceptance of inheritance, file Modelo 650 and register the Dénia property in the heirs' names at the Land Registry.
We apply the Comunidad Valenciana reductions and bonus, which can include non-residents, to keep the inheritance tax as low as the law allows.
We coordinate with the family's advisers in their home country so the Spanish and foreign sides of the estate fit together.
These are orientative components, not a fixed quote. Your final figure depends on the estate, the heirs and their circumstances.

The Thompson family's father died in the UK, leaving a villa on the Montgó in Dénia and a Spanish will with a Brussels IV clause electing English law.
First steps
We gathered the death certificate, the title deed and the IBI receipt, and obtained NIE numbers for the children.
Choice of law
The Spanish will already elected English law under Brussels IV, so the estate passed the way the father intended.
Inheritance tax
As Group II heirs the children qualified for the Valencia 99% bonus, which minimised the inheritance tax.
Filings
We filed Modelo 650 within the six-month deadline and the Dénia plusvalía at the town hall.
Registration
We registered the villa in the children's names at the Registro de la Propiedad de Dénia.
Estate under English law, the Valencia bonus minimised the tax, and the title transferred without repeated travel.
Illustrative example based on real cases. Names changed. Figures vary by estate.
No Spanish will
What goes wrong: Probate of the Spanish property is slower and more expensive, relying only on a foreign will.
How we prevent it: We draft a Spanish will over your Spanish assets to speed up probate.
No Brussels IV clause
What goes wrong: Spanish forced-heirship rules (legítima) can override how you wanted your estate divided.
How we prevent it: We include a professio juris clause electing the law of your nationality.
Assuming non-residents cannot claim the Valencia bonus
What goes wrong: Families overpay inheritance tax believing the regional bonus is for residents only.
How we prevent it: We claim the Comunidad Valenciana bonus where it applies, including for non-residents.
Missing the six-month deadline
What goes wrong: Surcharges and interest apply once the Modelo 650 deadline passes.
How we prevent it: We file within the deadline, or request an extension within the first five months.
Forgetting the Dénia plusvalía
What goes wrong: The municipal IIVTNU on the inheritance is overlooked and falls due late.
How we prevent it: We file the Dénia plusvalía and apply the habitual-residence bonus where it applies.
Under Spanish forced-heirship rules, the legítima can override your intentions about who inherits. Under EU Regulation 650/2012 (Brussels IV), most foreign nationals can elect the law of their nationality to govern the whole estate, but the tax is still Spanish. Making that professio juris election in a Spanish will is the single most useful step most foreign owners can take.
